Abstract

Legal Politics about the rights of dominating by state against the land if it is discovered from the Constitutions 1945, there are two correlated at least, namely: First, Soil, water and natural resources dominated (well regulated) by state; Second, The authority by state directed for developing people prosperity. The word dominated or dominating by state here can not be translated that state is the direct owner of the entire natural resources. Dominating in law has the meaning “regulating”, because the right of personal property is recognized as stated in Article 28H paragraph (4) Constitution 1945 which says: “ every persons has right for individual property and this property right may not be taken over arbitrarily by anyone”.
